By downloading or utilizing Scraibe, you acknowledge and consent to the stipulations within this combined Terms of Service & Privacy Policy ("Agreement"). Should you disagree with any segment of this Agreement, please abstain from using the App. Your engagement also implies adherence to the Apple App Store's Terms and Conditions.

Data Privacy & Management

• On-device Transcription: For transcriptions processed on-device, Scraibe operates without server engagement, ensuring data remains on your device.
• Cloud-based Transcription: Should you opt for cloud-based transcription, your uploaded files are expunged following transcription creation. Transcripts, in turn, are eliminated post-download to your device.
• Data Interest & Usage: Scraibe's interest in user data is minimal, purely to facilitate efficient service. We value your privacy and do not seek exhaustive user data.
• External Tracking: No personally identifiable data is stored. For elementary user engagement tracking, a self-hosted Countly instance is employed, and Sentry is used for error logging. Both platforms are solely operated by the app developer, ensuring your data's integrity.

Service Use & Limitations

The App, both on-device and cloud-based services, is tendered "as is" and "as available," devoid of any explicit or implicit guarantees. We cannot guarantee uninterrupted service or availability, especially for cloud-based transcription, which shouldn't be employed for critical applications.

Financial Terms, Feature Access & Credit Usage

• In-App Feature Procurement: Scraibe provides users the opportunity to enhance their experience through in-app purchases. These acquisitions grant access to a spectrum of features, which once unlocked, become a permanent part of your Scraibe experience without any recurring fees.
• Cloud Credit System & Billing Protocol: When you choose our cloud-based transcription service, you'll be navigating a credit-based system. These credits are treated as consumable products within the framework of Apple's guidelines. Each transcription process is billed on a per-minute basis. To provide clarity, any transcription duration that begins, regardless if it's a fraction of a minute or the full duration, will be counted and billed as one complete minute.
• Refund Policy & Credit Adjustments: All in-app purchases, including cloud credits, are governed by the refund policies of the Apple App Store. While we align with these guidelines, any requests for cloud credit refunds or adjustments are subject to review on a case-by-case basis, ensuring fairness and customer satisfaction. The final decision, in such instances, remains at the discretion of the app developer.

Disclaimer & Liabilities

Scraibe, to the utmost extent permissible by prevailing laws, disavows liabilities from any direct or indirect damages resulting from the App's use or non-use. This encompasses potential loss of data, profits, or other non-tangibles.

Indemnification

Users agree to shield and not hold the developer or its affiliates accountable from any damages or claims resulting from breaching these Terms or from the App's usage, barring cases rooted in our deliberate misconduct or negligence.

Jurisdiction & Governing Law

This Agreement abides by the laws of the app developer's domicile jurisdiction. Any dispute emerging from this Agreement will be addressed within the courts of the said jurisdiction.
